These Terms and Conditions ("Terms") govern your use of the Scora mobile application and associated services ("Services"), owned and operated by Scora, a limited liability company ("Company," "we," "our," or "us").
By accessing or using the Services, you ("User" or "you") agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
1. Scope of Services
Scora is a music discovery and analytics platform that allows users to connect their music streaming accounts (such as Spotify) to track listening habits, discover new music, and gain insights into their music preferences. The Company does not own, license, or distribute any music content.
All music content accessed through the app is provided by third-party streaming services. The Company's role is limited to analyzing and presenting data retrieved from these services with your authorization.
2. Third-Party Service Integration
By connecting third-party accounts (e.g., Spotify) to Scora, you acknowledge and agree that:
- You authorize Scora to access your listening history, playlists, saved tracks, and other data as permitted by the third-party service's API.
- Your use of third-party services remains subject to those services' own terms of service and privacy policies.
- The Company is not responsible for any changes, interruptions, or discontinuation of third-party services or APIs.
- The Company does not store your third-party login credentials; authentication is handled securely through OAuth protocols.
3. User Accounts
To use certain features of the Services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials.
- Notify us immediately of any unauthorized access to your account.
- Accept responsibility for all activities that occur under your account.
You may not use another person's account, create multiple accounts, or use usernames that are offensive, misleading, or infringe on others' rights.
4. Username Policy
Usernames must:
- Contain only letters and numbers.
- Not contain profanity, hate speech, or offensive language.
- Not impersonate other individuals, brands, or entities.
We reserve the right to reject or revoke any username at our sole discretion.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful, abusive, or fraudulent purpose.
- Attempt to reverse engineer, decompile, or extract source code from the app.
- Interfere with or disrupt the Services or servers.
- Scrape, harvest, or collect data from the Services without authorization.
- Share, sell, or transfer your account to another person.
- Use automated systems or bots to access the Services.
6. Intellectual Property
All content, features, and functionality of the Services—including but not limited to text, graphics, logos, icons, and software—are owned by the Company and protected by intellectual property laws.
Music content, album artwork, and artist information displayed in the app are owned by their respective rights holders and are accessed through authorized third-party APIs.
7. Data and Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information and music data.
By using the Services, you consent to the collection and use of your data as described in the Privacy Policy.
8. Subscription and Payments
Certain features may require a paid subscription. By subscribing, you agree to:
- Pay all applicable fees as disclosed prior to purchase.
- Authorize recurring charges unless you cancel your subscription.
- Accept that subscription fees are non-refundable except as required by law.
Payments are processed securely through third-party payment processors. The Company is not responsible for payment processing errors caused by third parties.
9. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose.
- Accuracy, reliability, or completeness of music data or analytics.
- Uninterrupted or error-free access to the Services.
- Compatibility with third-party services or devices.
10. Limitation of Liability
To the maximum extent permitted by law, Scora and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data, revenue, or profits.
- Inability to access or use the Services.
- Errors or inaccuracies in music data or recommendations.
- Actions or policies of third-party services (e.g., Spotify).
- Unauthorized access to your account due to your failure to maintain security.
11. Indemnification
You agree to indemnify, defend, and hold harmless Scora, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Services.
- Your violation of these Terms.
- Your violation of any third party's rights.
12. Termination
We reserve the right to suspend or terminate your account at any time, without notice or liability, for any reason including but not limited to:
- Violation of these Terms.
- Misuse of the platform.
- Engagement in harmful, illegal, or fraudulent behavior.
- Extended periods of inactivity.
Upon termination, your right to use the Services ceases immediately.
13. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the app. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
We may notify you of significant changes via email or in-app notification.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits or class-wide arbitration.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of laws principles.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
